The Small Claims Court is a specialized court created with specific duties and powers and is a branch of the Superior Court of Justice. It is designed to provide judicial determinations regarding disputes involving small amounts (up-to $35,000) of money and/or other forms of restitution. Its procedure is designed to be inexpensive, speedy and simple. Some reasons to initiate a claim include:

What is the common procedure and timeframes of resolution?

Communicating with the opposing party by sending a letter requesting resolution with our position and/or expectations.
Negotiating with the opposing party (or parties) to come to reach an amicable resolution.

If the matter is still unresolved, initiating a claim with the Small Claims Court to seek a judgment and/or to put pressure on the other side to settle.
